With the entry into force of Law 11/2023 (HERE you can consult it), another of the interesting new features brought to us by the Citizen's Notarial Portal is the possibility of choosing online the Notary with whom we want to sign our mortgage loan.

We will now see how to access this option and the steps to follow.


How can I choose the Notary I want to sign my mortgage loan in the Notarial Portal?

In order to be able to choose online the Notary with whom we want to sign our mortgage loan, the first thing to take into account is that, for this to be possible, the citizen must be registered in the Citizen's Notarial Portal (HERE), which is the web page created by the Spanish Notary Public's Office to implement all these telematic novelties of Law 11/2023.

What steps will be involved in the online process of choosing a Notary Public for my mortgage loan signing?

As a previous step, of course, to be able to choose the Notary with whom you want to sign your mortgage loan, it is necessary that you have negotiated with your bank the formalization of that loan, as well as the applicable conditions. 

Once you have negotiated your loan and signed with the bank the pre-contractual documentation of the transaction, your bank must upload all this information to the web portal that connects the financial institutions with the Notaries, at which point, we will be able to choose the Notary.

In case all these prerequisites are fulfilled, in order to choose the Notary with whom you want to sign your mortgage loan, the main steps of the process, in a very summarized form, will be the following ones:

  1. First, through the Citizen's Notary Portal, you must select your loan, in order to specify which specific transaction you want to sign with your trusted Notary.
  2. Secondly, you will have to choose the Notary of your confidence with whom you prefer to sign your mortgage loan, all this through a simple telematic process that we will explain below.
  3. Finally, once the Notary has been selected, you will have to meet with the chosen Notary to receive the prior advice provided for in the mortgage legislation. For this purpose, you will have to arrange a date and time with the chosen Notary, and once fixed, meet with him/her in person in his/her notary's office to sign the so-called LCI transparency act.

What steps do I have to follow in the Notarial Citizen Portal in order to select the Notary Public for my mortgage loan?

As indicated at the beginning, once we are registered in the Notarial Citizen Portal, we must access it with our user name and password, and there, in the home screen, we must select the option "Loans and policies" (bottom left).

And, within this screen, select the "Mortgage Loans" option:

Once inside the following screen, you must select the option "Select your notary" (green button), and start filling in your application:

And then complete all the following stages of the process:

1.- REVIEW OF THE INFORMATION

In this first step, intended to verify the user's consent in the selection of a Notary for the signing of the mortgage loan, you must accept the "Privacy Policy" (blue tick at the bottom left of the screen) and select the green "Next" button, in order to start the process.

2.- SELECT THE MORTGAGE LOAN

In this second step, a list will appear with all the mortgage loans that, if any, you have pending to sign.

So, if you have more than one pending, you will have to identify the corresponding one and click on the "Select" option:

3.- SELECT YOUR NOTARY

In this third step, you must choose the Notary with whom you want to sign your mortgage loan, making a search and selection by clicking on the "Search for another notary" button.

Once you have selected this button, an additional screen will open with fields to search for your trusted Notary, where you will be able to locate him/her by location, name and surname of the Notary.

4.- SUMMARY AND SHIPMENT

In this fourth and last step, a summary of your request will appear with all the data (of the loan and of the chosen Notary).

So, if everything is correct, the only thing left to do is to complete the procedure. To do so, we must select the green "Send" button that will appear at the bottom of the screen:

To complete the procedure, an additional screen will appear, where we will have to enter a security code that the NCP will have sent us, in SMS format, to the cell phone that we informed when we registered in the Citizen's Notarial Portal:

In such a way that, once the "Validate" button has been entered and selected, if all the steps have been completed correctly, a screen will appear with the message "Process completed successfully", to give us the peace of mind that we have been able to correctly select the Notary with whom we want to sign our mortgage loan.

Thus, once the application has been successfully submitted, your selected Notary Public will contact you in a short period of time to start the process of signing your mortgage loan.


What are the advantages of choosing online through the PNC the Notary with whom you want to sign your mortgage loan?

As we have just seen, the possibility of choosing online the Notary with whom you want to sign your mortgage loan is very useful for the citizen, since any future mortgagor, through a simple online procedure, will be able to choose with total freedom the Notary with whom he wants to formalize his mortgage loan, beyond the preferences that other people involved in the purchase process may have (such as, for example, a financial entity, a real estate agency, etc.). 

Thus, from our home, comfortably, with our computer, through a telematic procedure, we will be able to choose the Notary that best suits us to sign such an important act in the life of a person as a mortgage loan, through a completely free choice and without influences from third parties.


Can I choose the Notary with whom I will sign my mortgage loan in any other way?

Of course, if you wish, you can transfer your choice directly to the bank when you sign your pre-contractual documentation, which must respect it, since at the time of signing a mortgage loan, the debtor has the right to choose the Notary with whom he wants to sign his mortgage loan.

You can also, if necessary, choose your Notary by going to his or her office in person and requesting his or her assistance in this regard.
